That is incorrect.  Dogwood Health Trust can in fact pursue monetary damages from HCA using binding arbitration under the rules of the American Arbitration Association. In situations in which monetary damages are not an adequate remedy (for example, only injunctive relief will suffice), Dogwood Health Trust can pursue a claim for specific performance from a court of competent jurisdiction.
